Probation supervision is a new type of punishment that has appeared in Ukraine: what is known
President Volodymyr Zelenskyy has signed a law introducing a new type of criminal punishment under martial law in Ukraine – probationary supervision.
This is stated in the card of the law No. 9185.
Probation supervision involves a comprehensive impact on the offender without isolation from society. Such punishment can be imposed for a term of 1 to 5 years (1-2 years for minors).
According to the draft law, the punishment in the form of probationary supervision will consist of restrictions on the rights and freedoms of the convicted person, as defined by law and established by a court verdict, with the use of supervisory and social and educational measures without isolation from society.
That is, those sentenced to probation supervision are obliged to fulfill the duties prescribed by law and imposed by the court and to appear when summoned by the authorized probation authority. Sometimes convicts can be subjected to electronic bracelets.
This type of punishment will be an alternative to restriction of liberty. According to the draft law, probationary supervision will replace criminal punishment in the form of arrest (except for criminal offenses committed by military personnel).
What will it do?
The authors of the law assure that it will help humanize the penitentiary system and expand opportunities for rehabilitation without isolation from society.
They predict that the adoption of the law will optimize the activities of pre-trial detention centers, which will help reduce the number of people in detention centers and provide additional opportunities for the correction of offenders without isolation from society.
Back in 2020, the Ministry of Justice stated that replacing restriction of liberty with probationary supervision for those who committed non-violent crimes and were in correctional centers would help the state save money. They will be used to improve the infrastructure of the penitentiary system.
