The Verkhovna Rada of Ukraine allowed the placement of state registers outside Ukraine

On March 15, the Verkhovna Rada approved more than a dozen important initiatives against the background of the war. Among them – the bill on tax benefits № 7137-d and another equally important № 7152 on the creation of backup copies of state information resources and protection of information in martial law.

Thus, during the period of martial law in Ukraine and 6 months after its termination or abolition, the owners of state information resources may enter into agreements on the technical administration of relevant registers with foreign companies.

In particular, the bill provides for:

  • creation of backup copies of state information resources in compliance with the requirements established for such resources regarding their protection, integrity, confidentiality, and their placement outside Ukraine;
  • possibility of placing information and communication systems, electronic communication systems, public electronic registers outside Ukraine.

In addition, it is prohibited to place systems and store backup copies of state information resources and systems:

  • on the territory of Ukraine, where the state authorities of Ukraine temporarily do not exercise their powers
  • territories of the states recognized by the Verkhovna Rada as aggressor states,
  • in the territories of the States subject to sanctions,
  • territories of states that are members of customs and military alliances with such states are prohibited.

This will ensure the proper functioning of information and communication systems, electronic communication systems, public electronic registers owned by public authorities, local governments, state and municipal enterprises, institutions, organizations related to their management and protection of information, processed in them, under martial law.

Earlier, in an interview with Reuters, Viktor Zhora, deputy head of the State Service for Special Communications and Information Protection of Ukraine, admitted that government officials considered the transfer of state data, including servers, to another (friendly) country as a contingency plan. Now it will be possible.
