He received a summons and sued for a tidy sum: how a resident of Lviv region managed to do it
In Lviv region, a court found the delivery of a summons to a resident of the region to be illegal and ordered him to pay compensation from the state budget in the amount of UAH 20,000.
“On the morning of October 5, 2022, in Horodok, Andriy Ts. was walking his dog when he was stopped by law enforcement officers. The man stated that law enforcement officers threatened him with a summons and accused him of violating traffic rules (crossing the road outside the crosswalk). Andriy Ts. was handcuffed and taken to the filtration center, where he was issued a summons to the military commissariat, and then taken to the district police department,” reads the text of the court decision of August 2023.
The man managed to prove in court that he had not violated traffic rules and the decision to fine him UAH 255 was canceled. He also stated that the police’s actions had led to a negative impact on his health. According to him, he was beaten during his detention, which caused a hypertensive crisis.
The man himself considers his detention to be illegal and appealed to the court to receive compensation for the actions of the police.
“The moral damage was caused not only by the fact of his unlawful prosecution, but also by the fact of his unlawful detention, the unjustified use of special means – handcuffs, his unjustified delivery to a filtration camp, and not to the police department, as required by law, the issuance of an unjustified summons, etc.”, – the lawyer Andriy Ts. was quoted as saying.
At the court hearing, law enforcement officers presented their version of the events. According to one of the policemen, they saw a man crossing the road outside the pedestrian crossing and reacting inadequately to their remarks. He also had no documents on him. The man was detained but released after identification. According to the police officer, the plaintiff had grabbed one of them, so they were forced to handcuff him.
