Trump was excluded from the presidential race in Colorado by a court order

The Supreme Court of Colorado has banned the 45th President of the United States Donald Trump from running for president and excluded him from the state’s primaries.

This was reported by the Associated Press agency with reference to the court decision.

The court overturned a November ruling by a district court judge who said Trump provoked the uprising with his role in the January 6, 2021, attack on the Capitol, but stressed that he could not be barred from voting.

In the new ruling, the majority of judges believe that Trump is not eligible to hold the office of the White House under Section 3 of the 14th Amendment to the U.S. Constitution.

The 14th Amendment provides that no person who has participated in an insurrection or rebellion against the government may run for public office.

Chief Justice of the Colorado Supreme Court Brian D. Boatwright dissented from the decision, stating that “the constitutional issues are too complex to be resolved in a state court hearing.” Judges Maria E. Berkenkotter and Carlos Samur also dissented.

“Our government cannot disqualify anyone from holding public office without due process. Even if we are convinced that a candidate has committed terrible acts in the past – dare I say, participated in an insurgency – due process must be followed before we can declare that person ineligible to hold public office,” Samour said.
